Why does the Terms of Use include an arbitration agreement?
It has become increasingly common for individuals and companies to prefer to use arbitration to resolve disputes due to its benefits. As such, we have also decided to adopt it. You can read more about arbitration here.

Can I and how do I opt out of the arbitration agreement?
The right to opt out of the arbitration agreement applies only to users who created an account with us before 30 September 2024. If you are eligible to opt out and wish to do so, you will need to complete and submit an opt-out form online within the deadline. Is there a deadline to opt out of arbitration?
Yes, if you wish to opt out, you must do so within 30 days from the earlier of our email notifying you of the updated Terms of Use or you being notified of the update via an on-platform message on the Viki Service. Please visit this help page for more information on how to opt out.

What happens if I miss the deadline to opt out?
If you miss the deadline, you will not be able to opt out of the arbitration agreement and will be bound by it.

What are the implications of opting out of the arbitration agreement?
If you opt out of the arbitration agreement, disputes between you and us will be resolved through other processes, such as court litigation, by default instead of arbitration.

What are the implications of not opting out of the arbitration agreement?
If you do not opt out of the arbitration agreement, this means that all disputes between you and us will be resolved through arbitration, and you also waive certain rights, such as the right to maintain a court action and the right to participate in any class or representative claim. This also means that you will not be able to participate in the ongoing class action litigation against us in Ade, et al. v. Viki, Inc., N.D.Cal. Case No. 3:23-cv-02161. Will opting out affect my account or services in any way?
No, opting out of the arbitration agreement will not affect your account or your use of the Viki services.

Can I opt out of other parts of the Terms of Use?
No, you can opt out of the arbitration agreement only.

Can I change my mind after opting out?
Once you opt out, you will not be able to change your mind.

What if I entered the wrong email address in the opt-out form?
If you entered the wrong email address, please resubmit the form with the correct email address, within the 30-day time period. Please note that for your opt-out request to be valid, you need to submit the correct email address that is currently linked to your Viki account. I no longer have access to the email address associated with my account. How can I opt out?
If you are unable to access your email address that is currently linked to your Viki account, you can still opt out of the arbitration agreement by providing the email address in the opt-out form. However, we would recommend that you update your email address linked to your Viki account before you submit the opt-out form. To update your email address, please follow the steps here.

I can’t access my Viki account that I logged in using a Social login (Google Login, Facebook, Rakuten ID, etc). How do I opt out?
If you are unable to access your Viki account via a Social login but your Viki account is linked to an email address, you can still opt out of the arbitration agreement by providing the email address in the opt-out form. If your Viki account is not linked to an email address and you are unable to log into your account, please contact the Viki Support team for assistance by submitting a request using this form to update your email address before you submit the opt-out form.-

How will I know if my opt-out request has been received?
After submitting the opt-out form, you will see a pop-up notification on your screen confirming that your request has been submitted. You may wish to retain a copy of this email so that you have a record of your form submission. If your submission meets the requirements (see this page for more information), you will be opted out.
